Terms & Conditions of Purchase

By booking Products and/or Services online through needtoescape.com ("NTE") the Customer ("you") agree to the following terms and conditions. These Terms and Conditions together with your booking constitute the entire Contract between NTE and you for the supply of any Products and/or Services. No other Terms and Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email.

By proceeding with a booking, you agree for NTE to purchase the Products and/or Service you have selected based on these Terms and Conditions.

Information contained on the NTE website constitutes an invitation to treat. No information on our website constitutes or should be deemed as an offer by us to supply any Products and/or Service; however NTE will make every effort to supply the Product and/or Service to you.

We will notify you that your order is being processed by sending you a booking Confirmation and tax invoice via email; however, we do not formally accept your booking until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. Third party and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel bookings in their sole discretion.

All prices quoted are based on the exchange rate from Australian dollars, provided by XE.com. NTE accepts no responsibility for the quoted rate in currency other than Australian dollars.

Your credit card will be charged in Australian dollars. The difference in currency and charges relating to the foreign currency transaction will be payable by you.

We will confirm acceptance of your order when we send you an email confirming booking of the Product and/or Service you have ordered.

If we cannot process or accept your booking after payment is received you will be contacted by email or telephone.

Cancellation penalties depend on hotel policies. An administration charge (defined on the booking form) applies to all booking changes and cancellations. An administration fee of 14% of the total cost applies to all booking cancellations and amendments in addition to any hotel charge.

A refund will not be given for any product and/or service not used by you due to late arrival, early departure or by choice. This includes the failure of any transportation to operate as scheduled. NTE does not authorise any supplier including hotel management or NTE staff members to promise refunds on our behalf. No refund applies if the cost of you holiday is reduced for any reason after the final confirmation is advised.

NTE sells Products and/or Services from an inventory supplied by each supplier, and does not over-sell that inventory. NTE does not accept any liability for unavailability of that inventory caused by the supplier over-selling their own inventory.

You will be required to provide a credit card at hotel check-in to cover incidental charges and will be required to provide photo ID.

NTE makes its best efforts to ensure that the information available on its website is accurate. However, NTE cannot and does not guarantee that the site is free from errors or faults. NTE does not accept liability for any errors or omissions and reserves the right to change information published on the site at any time.

NTE does not accept liability for any indirect or consequential loss arising out of the use of, or connected with, its website or for any products and/or services purchased from its website.

NTE makes no warranty or representation about the fitness or suitability of any product and/or service advertised on its website.

NTE offers are not commissionable to registered Travel Agents.

You must be at least 18 years of age to book products and/or services on NTE. Should NTE suffer any damage or other losses as a result of a transaction entered into by a minor, NTE reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any booking(s) to be placed with NTE.

Bookings made to NTE by the Customer are made on behalf of the product Supplier. NTE act as an agent for the supplier. You agree that the supplier has sole responsibility for delivery of the product and/or services booked by you and NTE is not liable for default by the Property.

In situations of natural disaster or political unrest, product and/or services may not be available after purchase. NTE will find you alternate substitute for your purchase of a similar nature, standard and cost. If the arrangements offered are not accepted, a full refund will be offered. Should the alternate arrangement be accepted at a higher cost than originally charged, the additional cost will be charged to you. NTE will not bear the increase in cost of alternate arrangements.

A hotel facilities described by NTE does not indicate the use of these are free of charge and/or are functional all year round. A charge may apply and is at the discretion of the supplier.

Travel insurance is not included in any prices quoted by NTE. NTE strongly recommends that you purchase travel insurance the time of booking to cover yourself against loss of monies paid in the event of cancellation due to illness or other unforseen circumstances; as well as for medical expenses, loss of luggage and other expenses incurred.

Accommodation prices are generally based on standard or run of the house twin share accommodation. Requests for specific bedding types must be made at time of booking. Such requests cannot be guaranteed as suppliers may have limited availability of certain requested item ie bed types. Double rooms may have either twin or double beds. Single rooms are often smaller than other rooms and may contain only a single bed depending on the supplier. Triple rooms usually consist of a twin bedded room with an additional sofa bed, folding bed or rollaway for the third person. Please be aware the room may be crowed as a result. At all times, bedding configuration on NTE is as advised at that time by the supplier.

We endeavour to ensure that all your arrangements proceed smoothly. Problems may occur, in which case it is essential and most practical to resolve it locally with the supplier. You must inform NTE immediately if it fails. If you fail to take steps, any claim to compensate you may be reduced or denied. If you have an unresolved complaint, notify NTE in writing detailing the efforts that were made with the supplier to resolve the issue. Please send with supporting documentation within 30 days of the date of the booking. No claim made after this period will be considered.

You agree to pay NTE by debit to your credit card account the specified non refundable booking fee and cost of the accommodation. All fees are GST inclusive. NTE will issue Customer with a valid Tax Invoice in respect of this booking service

You acknowledge that a third party ("Card Authoriser") will process the credit card transactions required in respect of a booking. Customer agrees that NTE is not liable for default by the Card Authoriser.

NTE gathers personal information about you to process your booking. If NTE cannot gather this information, it will not be possible to make a booking in your name. NTE will not use or disclose your information in accordance with the Privacy Act 1988.

If you wish to make a booking, we will provide your information to the Supplier so they can process your booking.

These terms and conditions do not affect the Customers' statutory rights.

These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.

You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of NTE. Any unauthorised assignment shall be deemed null and void.

Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition.

NTE reserves the right to change the Terms and Conditions of sale at any time.

No NTE employee or agent has the authority to vary any of the Terms and Conditions governing any booking.
